Overview

BFKN Bankruptcy & Creditor Rights Group associate Alexander F. Berk recently coauthored Chapter 17 (concerning the intersection of UCC Article 9 and the Bankruptcy Code) for the 2024 edition of Commercial Bankruptcy Litigation, published by Clark Boardman Callaghan. The publication covers topics ranging from general bankruptcy and procedure to appeals, including general bankruptcy practice and procedure, petition and first-day motions, automatic stay, and debtor financing. The publication is organized into three sections: “Fundamentals” which encompasses all of the introductory material on commercial bankruptcy litigation; “Intersections” which provides detailed treatment on the crossover between bankruptcy law and other areas of law; and "Special Focus Topics" which is devoted to identifying chapters that cover special interest points within commercial bankruptcy litigation.

With experience representing both debtors and creditors of all sizes, Alex helps clients successfully navigate restructuring, bankruptcy, and insolvency matters both in and outside of court. He has experience in many key aspects of business reorganizations, workouts, and bankruptcies and represents secured and unsecured lenders, vendors, landlords, other creditors, and debtors in litigation and transactional matters in bankruptcy cases.
